Arizona Misdemeanor DUI Violations

Over the past few decades, many states—including Arizona—have developed stringent laws regarding DUI charges and punishments.

A misdemeanor is a type of crime that typically carries a punishment that may include up to year of jail time, a fine, required community service, or a probationary period.

In the state of Arizona, there are seven Arizona misdemeanor DUI violations; keep reading for a closer look at these violations and what they mean.


Underage Driving Under the Influence

Underage driving under the influence refers to a DUI violation committed by a person younger than the legal drinking limit of 21.

It is illegal for anyone under the age of 21 to drive a vehicle with any detectable percentage of alcohol in the blood.


Driving Under the Influence

Arizona law defines several misdemeanors for driving under the influence of alcohol or drugs, including “vapor releasing substances containing toxic substances” such as paints or varnishes.

It is illegal for any person to drive a vehicle while under the influence of these substances if they cause impairment of any degree.

Furthermore, it is unlawful for a person to drive a personal vehicle with a blood alcohol content of 0.08 or more or a commercial vehicle with a blood alcohol content of 0.04 or greater within two hours of getting behind the wheel.

It is also unlawful to be in control of a vehicle with any drug or its metabolite in the body.


Extreme DUI and Super Extreme DUI

Arizona defines an “extreme DUI” as driving a vehicle within two hours of possessing a blood alcohol content of 0.15 or higher but less than 0.20.

A “super extreme DUI” is defined as driving within two hours of possessing a blood alcohol content of 0.20 or more.
