Arizona and Alternative DUI Punishments

When you have a reputable, experience DUI attorney on your side, it is possible to make negotiations in your DUI case for alternative punishments instead of jail time. Often this goes hand-in-hand with a plea agreement.

Some alternatives to mandatory, full jail time sentences can include:

  • Work Release
Work release permits you to leave jail to go to work, but once you are done there you must return to jail. This is usually allowed for up to 12 hours a day, 6 days a week. This option is usually preferred over work furlough.

  • Work Furlough
This allows you to keep your job and go to work during the day, but with increased restrictions than work release. Work furlough programs involve the Probation Department who will keep in contact with your employer to make sure you are attending work when you leave jail. All paychecks must be handed over to a probation officer and they take out any fees involved with the work furlough system and return back to you anything that might be left over.

  • Home Arrest/DetentionAlternative DUI PunishmentsWhen under home arrest, you will wear an ankle bracelet constricting you to certain perimeters. If you breach them, authorities are alerted through the censor on your ankle bracelet. All city courts offer this option under different circumstances depending on your case. The anklet is usually worn for about one year, and can sometimes be granted as an alternative to a ignition interlock device.

  • City Jail
City jail is less crowded than county jail and tends to have a reputation for being safer and cleaner.

If you have been drinking, then do not drive.
